Terms of Service — Kesy India

1. Who these terms are with

Kesy is provided by Serveque Global Services Private Limited (“Serveque”, “we”, “us”), a company incorporated in India (CIN U74992WB2018PTC227127) with its registered office at 16 Adhar Chandra Das Lane, Kolkata, West Bengal 700067, India. Contact: support@kesy.ai.

These terms apply when you create a Kesy account or use Kesy (the “Service”). By doing so on behalf of a business, you confirm you are authorised to accept them for that business. Kesy is a business service; it is not intended for personal or household use.

2. The Service

Kesy provides an AI receptionist that answers phone calls for your business on a number we provide, and — with the optional Campaigns add-on — places outbound calls to contacts you choose. It is managed through the web dashboard at web.kesy.ai. There is no mobile app.

3. Your account

Keep your login secure and the information in your account accurate. You are responsible for activity under your account, including what Kesy is trained to say on your behalf.

4. Free trial

New accounts get a 7-day free trial with 100 minutes, with no payment card required. In India the trial runs on a shared Kesy trial number that only your registered test numbers can reach; a dedicated number is provided when you subscribe.

5. Plans, prices and billing

Premium costs ₹3,999 + GST per month and includes 500 call minutes. The Campaigns add-on costs ₹2,000 + GST per month and uses your plan minutes.
Calls are measured to the exact second. Plan minutes are used first, then prepaid minutes in your wallet; extra minutes are charged at ₹7 per minute or through prepaid packs. Prepaid minutes do not expire while your account is open.
Subscriptions renew monthly until cancelled. Payments are processed by Razorpay.
Prices are exclusive of GST, which is added at the applicable rate and shown on your invoice.
We may change prices with at least 30 days’ notice by email; the change applies from your next billing period.

6. Phone numbers

Numbers we provide are leased to you for as long as your subscription is active and remain under our and our carriers’ control. If your subscription ends, the number may be released and reassigned after 30 days. You may forward your own existing number to Kesy.

7. Your responsibilities

What Kesy says. You are responsible for the information you give Kesy and for checking that its answers about your business are accurate.
Recording and disclosure. Kesy records and transcribes calls. You are responsible for informing callers where the law requires it.
Outbound calls. You may only call people you are legally allowed to call. You must comply with the TRAI Telecom Commercial Communications Customer Preference Regulations, 2018, including respecting DND preferences, and only call contacts who have agreed to hear from you.
Opt-outs. You must honour requests not to be called. Kesy adds people who ask to your block list; you must not remove them without fresh consent.

8. Acceptable use

You must not use Kesy to: break any law; make harassing, deceptive, threatening or fraudulent calls; impersonate a person, business or government body; collect payment card or banking details by voice; give regulated professional advice (medical, legal or financial) as if from a licensed professional; call emergency numbers; place calls outside permitted hours or to people who have opted out; or reverse-engineer, overload or resell the Service without our written permission. We may suspend calling immediately if we reasonably believe the Service is being misused.

9. AI limitations

Kesy uses artificial intelligence and can make mistakes — it may mishear a caller or answer imperfectly. It is not a substitute for professional advice and must not be relied on for emergencies. Review important calls and summaries yourself.

10. Your data and ours

You own your business data, recordings, transcripts and contact lists. You give us permission to process them only to provide and support the Service, as described in our Privacy Policy. For call and contact data about your callers, we act on your behalf as your service provider (data processor). We own the Kesy software, brand and website.

11. Availability

We work to keep Kesy available around the clock, but we depend on carriers, AI and cloud providers and cannot promise uninterrupted service. We will try to give notice of planned maintenance.

12. Cancellation and termination

You can cancel at any time from your dashboard; the Service continues until the end of the period you’ve paid for. Refunds are covered by our Refund & cancellation policy. We may suspend or end your account if you seriously or repeatedly breach these terms or fail to pay.

13. Liability

To the extent the law allows: the Service is provided “as is”; we are not liable for indirect or consequential losses, lost profits or missed business opportunities; and our total liability for any claim is limited to the fees you paid us in the 3 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.

14. Indemnity

You agree to cover our reasonable losses arising from claims that your outbound calls, contact lists or use of the Service broke the law or these terms.

15. Governing law

These terms are governed by the laws of India, and the courts at Kolkata, West Bengal have jurisdiction.

16. Changes

We may update these terms. We will email you about material changes at least 15 days before they take effect. Continuing to use Kesy after that means you accept the updated terms.
